TERMS OF SERVICE (CANE Waste Management LLC)

These Terms of Service ("Terms") govern the use of services provided by CANE Waste Management LLC ("CANE Waste Management," "we," "us," or "our") to individuals and entities in the state of New Hampshire ("Customers" or "you"). By engaging with our services, you agree to comply with these Terms. Please read them carefully.

1. Service Provision

1.1. CANE Waste Management provides solid waste removal and management services, including collection, transportation, and disposal of solid waste materials, within the state of New Hampshire.

1.2. Our services are offered to residential, commercial, and industrial customers, subject to the terms and conditions outlined herein.

1.3. The specific details of our services, including scheduling, frequency, and pricing, will be agreed upon with each customer individually, based on their requirements.

2. Customer Responsibilities

2.1. Customers shall provide accurate and complete information regarding the type and volume of solid waste to be collected. Any changes or updates to the information provided should be communicated promptly to CANE Waste Management.

2.2. Customers must ensure that the waste is properly segregated and placed in suitable containers or packaging as instructed by CANE Waste Management. Hazardous or prohibited materials must not be included in the waste for collection.

2.3. Customers are responsible for ensuring safe and unobstructed access to the waste collection areas, including clearing driveways, walkways, and parking areas of any obstacles that may hinder our collection vehicles.

3. Service Limitations

3.1. CANE Waste Management shall not be held liable for any delays, disruptions, or failures in service provision due to factors beyond our reasonable control, including but not limited to acts of nature, accidents, equipment failure, or regulatory requirements.

3.2. We reserve the right to refuse the collection of waste that does not comply with legal, safety, or environmental standards or poses a risk to our personnel, equipment, or the environment.

3.3. CANE Waste Management does not assume responsibility for any damage or loss to property or personal belongings during the waste collection process unless such damage or loss is a direct result of our negligence or willful misconduct.

4. Billing and Payment

4.1. Customers will be billed according to the agreed-upon pricing and payment terms. Invoices shall be sent on a periodic basis (e.g., monthly, quarterly) or as otherwise specified in the service agreement.

4.2. Payment is due within the specified timeframe stated on the invoice. Late payments may incur additional charges, including but not limited to interest, penalties, or collection fees.

5. Termination

5.1. Either party may terminate the service agreement upon providing written notice to the other party, subject to any minimum contract period or applicable termination fees outlined in the agreement.

5.2. CANE Waste Management reserves the right to suspend or terminate services immediately if a customer violates these Terms, fails to fulfill their payment obligations, or engages in any unlawful or unethical activities.

6. Confidentiality and Privacy

6.1. CANE Waste Management will treat all customer information as confidential and will not disclose it to third parties unless required by law or with the customer's explicit consent.

6.2. We will handle personal data in accordance with applicable privacy laws and our Privacy Policy, which outlines how we collect, use, disclose, and protect personal information.

7. Governing Law and Dispute Resolution

7.1. These Terms shall be governed by and construed in accordance with the laws of the state of New Hampshire, without regard to its conflict of laws principles.

7.2. Any disputes arising out of or in connection with these Terms shall be subject to

the exclusive jurisdiction of the state and federal courts located in the state of New Hampshire.

8. Modifications to the Terms

8.1. CANE Waste Management reserves the right to modify these Terms at any time. We will provide notice of any material changes, and your continued use of our services after such changes will constitute acceptance of the revised Terms.
